The UK's Competition and Markets Authority (CMA) unveiled its comprehensive report on September 18, which follows an initial review of foundation models (FMs). These findings have led to the proposal of essential principles aimed at placing consumer protection and healthy competition at the core of responsible FM development and usage.
Foundation models, often referred to as FMs, represent a transformative leap in the realm of artificial intelligence (AI). These versatile AI systems possess broad capabilities that are adaptable for various specific purposes. Recent advancements in FMs have rapidly integrated into diverse user applications, such as ChatGPT and Office 365 Copilot, underlining their potential to stimulate innovation and drive economic growth. The impact of FMs extends beyond mere convenience, as they have the capacity to revolutionize our daily lives, working practices, and various industries. These changes can manifest swiftly, exerting substantial influence on individuals, enterprises, and the broader UK economy.
The CMA's report accentuates the manifold benefits awaiting people and businesses if FMs are developed and employed responsibly. Potential advantages encompass the emergence of novel and superior products and services, improved access to information, groundbreaking scientific and medical breakthroughs, and lower pricing structures. Furthermore, the prevalence of FMs could empower a broader spectrum of companies to compete successfully, effectively challenging the existing market leaders. This heightened competition and innovation could prove advantageous for the entire economy, bolstering productivity and fostering economic growth.
However, the report also sounds a cautionary note, emphasizing the risks associated with weak competition or disregarding consumer protection laws within the FM domain. These risks could encompass significant exposure to false and deceptive information and AI-enabled fraudulent activities. Over the long term, a select few corporations might exploit FMs to consolidate their market power, failing to offer superior products or services while imposing high prices.
Although the report acknowledges the presence of other pressing concerns related to FMs, such as copyright and intellectual property rights, online safety, data protection, and security, the CMA's initial review focused exclusively on competition and consumer protection issues.
The proposed principles are intended to guide the continued development and utilization of FMs, ensuring that individuals, enterprises, and the economy reap the full benefits of this technological advancement. These principles draw upon insights derived from the evolution of other technology markets and how they might be applied to FMs as they continue to evolve.
The proposed guiding principles are as follows:
1. Accountability: FM developers and deployers are held responsible for the outcomes provided to consumers.
2. Access: Ongoing unrestricted access to key inputs is ensured without unnecessary limitations.
3. Diversity: A sustained diversity of business models, including both open and closed, is promoted.
4. Choice: Enterprises are afforded sufficient choice to determine how to utilize FMs.
5. Flexibility: The flexibility to switch and/or employ multiple FMs as needed is guaranteed.
6. Fair Dealing: No anti-competitive behavior is tolerated, including anti-competitive self-preferencing, tying, or bundling.  
7. Transparency: Consumers and businesses receive information concerning the risks and limitations of FM-generated content, enabling informed choices.
Over the forthcoming months, the CMA intends to engage in extensive dialogue with a broad spectrum of domestic and international stakeholders. This collaborative effort aims to further refine these principles, fostering effective competition and consumer protection to benefit people, businesses, and the economy.
Sarah Cardell, CEO of the CMA, asserted, "The speed at which AI is becoming part of everyday life for people and businesses is dramatic. There is real potential for this technology to turbo charge productivity and make millions of everyday tasks easier – but we can’t take a positive future for granted. There remains a real risk that the use of AI develops in a way that undermines consumer trust or is dominated by a few players who exert market power that prevents the full benefits being felt across the economy."
Cardell continued, "The CMA’s role is to help shape these markets in ways that foster strong competition and effective consumer protection, delivering the best outcomes for people and businesses across the UK. In rapidly developing markets like these, it’s critical we put ourselves at the forefront of that thinking, rather than waiting for problems to emerge and only then stepping in with corrective measures. That’s why we have today proposed these new principles and launched a broad programme of engagement to help ensure the development and use of foundation models evolves in a way that promotes competition and protects consumers. While I hope that our collaborative approach will help realise the maximum potential of this new technology, we are ready to intervene where necessary."
