US Court Holds NSO Group Liable for Device Infiltration via WhatsApp

On December 20, 2024, Senior Judge Phyllis J. Hamilton of the United States District Court for the Northern District of California declared Israeli company NSO Group liable for a hacking spree that compromised the privacy of over 1,400 WhatsApp users in 2019. WhatsApp, owned by Meta—the parent company of Facebook, Threads, and Instagram—alleged that NSO violated the U.S. Computer Fraud and Abuse Act (CFAA) and its terms of service, a finding confirmed by Judge Hamilton.

The Case Background

The case began in 2019 when WhatsApp, the globally popular messaging app, took the bold step of filing a lawsuit against NSO Group, a cybersecurity firm known for its controversial software. WhatsApp accused NSO Group of exploiting a critical vulnerability within its platform to infiltrate devices with the notorious Pegasus spyware. This highly sophisticated spyware, developed by NSO Group, is infamous for its ability to transform smartphones into powerful surveillance tools. Once installed, it covertly accesses private messages, records calls, and even activates cameras and microphones without the user's consent.

The implications of this invasion of privacy were particularly alarming, as the targets of such surveillance included journalists, human rights activists, and political dissidents—individuals whose work often puts them at odds with oppressive regimes. This raised significant ethical concerns about the use of technology in modern governance, emphasizing the grave violation of privacy rights and the potential for abuse of surveillance technologies.

The Ruling

Judge Hamilton's ruling pierced through NSO Group's defense, finding the company in violation of both federal hacking laws and California's state laws. This decision is pivotal because it directly implicates NSO Group in the unauthorized access of WhatsApp users' devices, marking a departure from the company's narrative that it merely licenses technology to governments without controlling its use.

The judge noted:

Defendants’ [NSO’s] relevant software products, collectively referred to as “Pegasus,”allow defendants’ clients to use a modified version of the Whatsapp application – referred to as the “Whatsapp Installation Server,” or “WIS. The WIS, among other things, allows defendants’ clients to send “cipher” files with “installation vectors” that ultimately allow the clients to surveil target users. As mentioned above, plaintiffs allege that defendants’ conduct was a violation of the CFAA, the CDAFA [California Comprehensive Computer Data Access and Fraud Act], and a breach of contract.

The court's findings were based on substantial evidence, including sworn depositions from NSO employees that contradicted the company's previous statements. These documents revealed NSO's active role in the installation and management of Pegasus, including its source code, which was accessible only to Israeli citizens physically present in Israel—contradicting claims that clients alone controlled the spyware's operations.

Implications for NSO Group and the Spyware Industry

WhatsApp's legal action was not merely a quest for redress in response to the egregious breach of trust; it aimed to establish a pivotal legal precedent. For years, NSO Group has sought to portray itself as a legitimate player in the cybersecurity field, maintaining that its technology was exclusively sold to government agencies for the noble purposes of crime prevention and counter-terrorism. 

However, this case has begun to unravel such narratives, exposing the concerning reality of NSO's direct complicity in the deployment and misuse of its invasive spyware. This ruling has profound implications for NSO Group. Beyond the immediate legal repercussions, it tarnishes the company's reputation, potentially affecting its business with governments worldwide. The case has also ignited a broader discourse on the ethical bounds of spyware sales and usage. 

For the spyware industry at large, this case serves as a cautionary tale, highlighting how companies operating in this shadowy space could face legal accountability, particularly when their products are used for human rights violations or unauthorized surveillance. WhatsApp's legal victory might inspire other victims of spyware to pursue similar actions, potentially fostering a more regulated environment for spyware vendors.

Impact on Digital Privacy

From a privacy perspective, this ruling is a watershed moment—not only setting a precedent in the world of digital surveillance but also sending a stark warning to the burgeoning spyware industry. It reinforces the notion that digital platforms have a duty to protect their users from such invasive technologies. Will Cathcart, the head of WhatsApp, celebrated the ruling as a "win for privacy," emphasizing that after a five-year legal battle, "NSO can no longer avoid accountability for their unlawful attacks on WhatsApp, journalists, human rights activists, and civil society." 

The case also highlights the ongoing challenge of securing communication platforms against state-sponsored cyberattacks. It has prompted WhatsApp and similar services to enhance their security measures, with WhatsApp now actively working on further encryption and security protocols to safeguard its users.

The Road Ahead

While NSO Group has not immediately responded in media by commenting on the ruling, the company's history suggests it might appeal or seek to mitigate the financial and reputational damage through legal maneuvers. However, the immediate next step is a trial to assess the damages NSO Group owes to WhatsApp, which could result in significant financial penalties. This case might also spur legislative action. Governments and international bodies might see this as an impetus to introduce or tighten laws around the sale and use of spyware, ensuring better safeguards against abuse.
