China's Regulatory Body Penalizes Evergrande for Bond Fraud Amidst Speculation

China's regulatory body, China Securities Regulatory Commission (CSRC), released a statement on Friday revealing that it has imposed penalties - 4.175 billion yuan ($587.67 million) - on the troubled developer China Evergrande Group for fraudulent activities related to the issuance of onshore bonds while issuing a lifetime ban from the securities market for Hui Ka Yan, also known as Xu Jiayin, the founder of the real estate developer, along with a fine of 47 million yuan. The announcement, however, mirrors what the developer disclosed back in March, raising questions about the timing and efficacy of the regulatory action.
According to the CSRC, the company inflated its revenue and profit by prematurely recognizing income, leading to the fraudulent issuance of publicly offered bonds on the exchange market. The annual reports for 2019 and 2020 contained false records. The exchange bond market is a crucial avenue for direct corporate financing, significantly lowering financing costs, improving efficiency, and reinforcing market discipline. While benefiting from the ease of financing, bond issuers must also enhance their awareness of legal compliance and investor protection.
The securities regulator's move comes amid growing speculation regarding potential penalties against PwC, China Evergrande Group's auditor. Hu Qimu, deputy secretary-general of the Digital-Real Economies Integration Forum 50, told the Global Times on Friday that the maximum penalty for Evergrande is essential to curb violations in the bond market. He emphasized the need to set clear boundaries since bonds are a form of direct financing and highlighted the importance of using Evergrande's case as a deterrent.
In response, Evergrande stated on Friday that it is making progress on key tasks, such as ensuring housing delivery, with over 80 percent of projects completed. The company pledged full cooperation with the CSRC and other regulatory authorities for follow-up actions.
Dong Shaopeng, a senior research fellow at the Chongyang Institute for Financial Studies at the Renmin University of China, stated on Friday that the regulator's approach aims to ensure the stable development of the housing market while demonstrating a strong commitment to eradicating securities fraud, illegal financial practices, accounting fraud, and other malpractices.
