How Foreign Direct Investment in South Carolina's Manufacturing Sector Is Reshaping Workplace Injury Liability

South Carolina’s rise as a global manufacturing hub is reshaping workplace injury claims as foreign-owned factories, complex supply chains, and multin

Over the past four decades, South Carolina has transformed itself into one of the most globally connected manufacturing economies in the United States. German, Japanese, French, and Chinese firms now operate sprawling facilities across the Upstate and along the I-85 corridor, supplying everything from luxury SUVs to commercial aircraft. According to the South Carolina Department of Commerce, foreign-owned enterprises now account for a larger share of manufacturing employment in the state than in almost any other U.S. jurisdiction. That structural shift has raised new questions about how workplace injury claims are handled when the employer is the U.S. subsidiary of a multinational headquartered overseas.

A New Industrial Map for South Carolina

The Spartanburg plant operated by BMW Manufacturing is now the largest BMW assembly facility in the world by output. According to the BMW Manufacturing Wikipedia entry, the plant employs more than 11,000 people and exports the majority of its production overseas. North Charleston is home to a major Boeing 787 final assembly line, while Michelin, Volvo Cars, Continental Tire, and Samsung have all built or expanded operations across the state since the early 2000s.

These facilities sit at the center of complex global supply chains. Components arrive from suppliers in Mexico, Germany, South Korea, and beyond. Production schedules are tied to demand cycles in Europe and Asia. The workforce is local. The injuries that occur in these plants are governed by South Carolina law, but the corporate structures behind them often span multiple jurisdictions.

That combination, local workers operating inside globally integrated supply chains, has reshaped what a workplace injury case looks like. A mechanic injured by a defective robotic arm in Greer is no longer dealing with a single domestic employer. The plant operator, the parent company, the foreign supplier of the machine, and contracted maintenance firms may all sit somewhere on the liability map.

Why Foreign Direct Investment Complicates Injury Claims

South Carolina is a workers' compensation state. For most workplace injuries, an employee's primary recovery comes through the state's no-fault system rather than a civil suit against the employer. But when a third party such as an equipment manufacturer, a contractor, or a parent company is at fault, an injured worker may have additional claims that fall outside the workers' compensation framework.

That is where the global character of South Carolina manufacturing matters most. Many of the heavy machines, robotic systems, and assembly tools used in foreign-owned plants are designed and built outside the United States. If a press in a Tier 1 supplier facility crushes a worker's hand because of a design defect, the responsible manufacturer might be a German or Japanese company with no offices in South Carolina. Pursuing that claim involves questions of personal jurisdiction, service of process under the Hague Convention, and the use of expert engineering testimony to translate foreign technical standards into terms a South Carolina jury can evaluate.

Insurance arrangements add another layer. Multinationals often layer general liability, product liability, and umbrella coverage across U.S. and foreign carriers, which can mean that the lawyer for an injured worker must coordinate with claims teams operating in different languages and legal traditions.

For an experienced perspective on these cases, McWhirter, Bellinger & Associates serving South Carolina has handled workplace and personal injury matters across the state for more than 45 years, with practice areas that include product liability, workers' compensation, and catastrophic injury. The firm's combination of South Carolina trial experience and willingness to take complex cases against well-resourced corporate defendants reflects what is needed in this environment, where an injured worker may be facing not just a local employer but a global parent company with deep pockets and a sophisticated defense team.

How Supply Chain Pressure Is Reshaping the Shop Floor

Several macroeconomic trends are now intensifying the risk environment inside South Carolina's foreign-owned plants. The U.S. and China trade environment has pushed many original equipment manufacturers to reroute production and shorten supply chains. Recent reporting from Reuters and other outlets has tracked how reshoring incentives in the Inflation Reduction Act and the CHIPS and Science Act have pulled additional capacity into the U.S. South.

The result, in practical terms, is more equipment being installed faster, more new hires being trained in compressed timeframes, and more pressure on plant managers to hit production targets that were originally set in headquarters thousands of miles away. Each of those pressures correlates with a higher probability of workplace injury. Federal data from the U.S. Bureau of Labor Statistics consistently shows that motor vehicle parts manufacturing, primary metal manufacturing, and machinery manufacturing all have above-average injury rates, and South Carolina hosts significant employment in each of those categories.

For South Carolina workers, the practical effect is straightforward. The size, sophistication, and capital intensity of these foreign-owned plants does not automatically mean they are safer. In some cases, the speed at which they have been built, expanded, and reorganized has cut against worker safety in ways that show up only after a serious injury occurs.

What This Means for Workers, Employers, and Policymakers

South Carolina's foreign direct investment story has been overwhelmingly positive for the state's economy. The complication is that the legal system that addresses worker injuries was largely built in an era when the typical employer was domestic, locally owned, and using equipment made in the same country. The current reality, in which a Greenville assembly line might contain machinery from six different countries and a corporate parent in Stuttgart or Tokyo, is something the system is still adjusting to.

For workers, the practical lesson is to document everything: the make and model of the machine involved, the maintenance history, the training records, and any communications with supervisors about safety concerns. For employers, the lesson is that compliance with U.S. workplace safety standards is a core operating responsibility, not a translation problem. And for policymakers, the long-term question is whether South Carolina's legal infrastructure can keep pace with the global economy the state has worked so hard to attract.
