The quality and thoroughness of this exam varies considerably, and a poorly conducted C&P exam is one of the most common reasons that valid claims are denied or under-rated.

The VA Rating System: How Disability Levels Are Assigned

The VA uses a percentage-based rating system to evaluate the severity of each service-connected disability. Ratings are assigned in increments of 10 percent, ranging from 0 percent - which acknowledges a service connection but indicates a condition not severe enough to warrant compensation - to 100 percent for total disability. The monthly compensation amount increases with the rating, and veterans rated at 100 percent receive significantly higher payments than those rated at lower levels.

When a veteran has multiple service-connected conditions, the VA uses a combined ratings formula rather than simply adding the percentages together. This formula, which applies ratings sequentially to the remaining non-disabled portion of the body, often produces a combined rating that feels counterintuitive and lower than veterans expect. Veterans who believe their combined rating does not accurately reflect the overall impact of their conditions have the right to appeal the decision.

Common Reasons VA Claims Are Denied or Undervalued

Denial and under-rating are unfortunately common outcomes in the VA disability system. Some of the most frequent reasons claims are denied include insufficient medical evidence linking the condition to service, a negative or inadequate nexus opinion from a C&P exam, missing service records, failure to establish a current diagnosis, and claims that are filed outside required timeframes for certain benefit types. Each of these issues is potentially correctable through the appeals process, but only if the veteran understands what went wrong and how to address it.

Mental health conditions, including PTSD, depression, and anxiety, are among the most frequently disputed disability claims. Veterans who experienced military sexual trauma, combat stress, or other in-service events may face particular challenges if their service records do not explicitly document the precipitating event. Buddy statements, personal statements, and supporting medical opinions from private providers can help fill these evidentiary gaps, but navigating this process without guidance is difficult.

The VA Appeals Process

Veterans who disagree with a VA decision have multiple pathways for appeal under the Appeals Modernization Act, which took effect in 2019. The three lanes are: a Supplemental Claim, which allows the veteran to submit new and relevant evidence; a Higher-Level Review, in which a more senior VA adjudicator reviews the original claim without new evidence; and an appeal to the Board of Veterans' Appeals, which offers additional options including hearings before a Veterans Law Judge. Each lane has its own timelines, rules, and strategic considerations.

The Board of Veterans' Appeals remains the most powerful avenue for challenging a denial, but it also carries the longest wait times, which can stretch to years. Veterans who reach the Board and remain dissatisfied with the outcome may further appeal to the U.S. Court of Appeals for Veterans Claims - a federal court with jurisdiction over VA benefit decisions. Having legal representation at the Board level and above dramatically increases the likelihood of a favorable outcome.
