The United States operates what is arguably the most commercially oriented bail system in the developed world. In Japan, defendants face a high rate of pretrial detention even for relatively minor offenses, reflecting a legal culture that places considerable weight on investigative needs and the risk of evidence tampering. New Zealand has in recent years moved toward risk-based assessment tools to guide bail decisions, reducing reliance on financial conditions.


In many developing economies, formal pretrial release systems are often poorly resourced, resulting in high rates of pretrial detention that can extend for months or even years before a case comes to trial. Research from organizations such as the World Pretrial Justice Initiative highlights the economic and social costs of prolonged pretrial detention in these contexts, including job loss, family disruption, and increased likelihood of conviction simply due to the pressures of incarceration.


The Future of Bail Reform


Bail reform movements have gained significant traction in the United States and globally over the past decade.
