After Tijuana Gang Violence, Mexico Back to Square One

After armed gangs hijacked and set fire to at least a dozen vehicles in the border city of Tijuana on Friday, the Mexican military flew hundreds of additional troops into the city on Saturday to beef up street patrols. This incident was the latest in a string of attacks that have targeted civilians across the country.

According to a story published on the website of the local newspaper Reforma, some 350 members of the Mexican National Guard (Guardia Nacional) were airlifted into the state of Baja California on Saturday to assist the thousands of other federal troops already present there.

Earlier Friday evening, staff at the US consulate in Tijuana were told to shelter in place until further notice, but no injuries were recorded during the hijackings that snarled traffic throughout the city and temporarily restricted access to one of the world's busiest border crossings.

Because of its location on the border with the United States-Mexico, Tijuana and the surrounding area are both profitable drug trafficking routes. Although it has been under the hands of the Arellano Felix cartel for a considerable time, there is speculation that it has become a battleground for multiple other criminal organizations.

The gang violence has spread across the border cities of Tijuana and Mexicali along with Rosarito and Ensenada, which included vehicles being set ablaze and road blockades. It was the third time this week that drug gangs in Mexican cities carried out extensive gunshots and arson attacks.

In the current situation, the President of Mexico, Andrés Manuel López Obrador, is mulling over proposals to circumvent the legislature and cede the legal authority of the National Guard to the army, a move that might extend the military's control over law enforcement.

Concerns have been raised regarding this matter as a result of the fact that President Obrador was successful in gaining approval for the creation of the National Guard in 2019 as a result of his pledge in the constitution to ensure that the force would remain under nominal civilian control and that the army would be removed from the Mexican streets by the year 2024. Since its inception, the National Guard has grown to 115,000, but almost 80% of its personnel were drawn from the military ranks. However, neither the National Guard nor the military has successfully brought the level of instability down across the country.

On the other hand, concerns regarding using military personnel in civilian law enforcement have been raised for a long time by the United Nations and other human rights organizations. Moreover, the Supreme Court of Mexico has not yet decided how to rule on several appeals that challenge what some people believe to be "unconstitutional tasks and responsibilities" that have been assigned to the National Guard.

Last week, the United Nations Office of High Commissioner for Human Rights (OHCHR) stated that militarizing civil institutions, such as the police force, is detrimental to democratic governance. Soldiers are not trained to do that; by its very nature, the military is not open to "scrutiny." In the past, it has been implicated in human rights abuses, and the presence of troops has not settled the critical matter of how to reform law enforcement, prosecutors, and courts.
