What Pre-Settlement Legal Funding Is - and Is Not


Pre-settlement legal funding is a financial arrangement in which a funding company advances a portion of a plaintiff's anticipated settlement or judgment before the case concludes. It is sometimes called a lawsuit loan, but the term is technically imprecise - unlike a conventional loan, pre-settlement funding is non-recourse in most cases. This means that if the plaintiff loses their case or receives no settlement, they owe the funding company nothing. The advance is repaid only if and when the case resolves favorably, typically from the proceeds of the settlement or court award.


This non-recourse structure distinguishes pre-settlement funding from personal loans, credit card advances, or borrowing from family and friends - all of which must be repaid regardless of the case outcome. Because the funding company is taking on the risk of a potential loss, it charges a cost for that risk, and understanding the cost structure is essential before entering any funding agreement.

How the Application and Funding Process Works


Applying for pre-settlement funding is generally straightforward and does not require a credit check or employment verification. The funding company evaluates the strength of the underlying legal claim, not the applicant's personal financial history. After an applicant contacts a funding provider, the company requests information about the case from the plaintiff's attorney. Pre-settlement funding is available for a wide range of personal injury and civil cases, including motor vehicle accidents, premises liability, product liability, medical malpractice, and workers' compensation claims. The primary qualification is having a viable legal claim with a reasonable expectation of a favorable outcome. Because the funding is non-recourse and the company's recovery depends on the case succeeding, funders are selective about the claims they advance against.


Having an attorney already retained is typically a requirement, not just a formality.
