India's lower house of Parliament (Lok Sabha) on April 17, 2026, failed to pass a constitutional amendment bill that sought to tie the implementation of one-third reservation for women in legislative bodies to a redrawing of electoral constituencies based on the 2011 census, marking the first defeat of a constitutional amendment proposed by the ruling Bharatiya Janata Party-led government in its 12 years in power. The bill, formally the Constitution (One Hundred and Thirty-First Amendment) Bill, 2026, fell short of the required two-thirds majority, receiving 298 votes in favor and 230 against among those present and voting, after two days of heated debate during a specially convened three-day parliamentary session.
The measure aimed to amend provisions related to the One Hundred and Sixth Amendment of the Constitution of India, enacted in 2023 and popularly known as the Nari Shakti Vandan Adhiniyam, which reserves as nearly as possible one-third of seats for women in the Lok Sabha, state legislative assemblies, and the Delhi legislative assembly for a period of 15 years. That 2023 legislation, passed unanimously in the Rajya Sabha and with overwhelming support in the Lok Sabha, stipulated that the reservation would take effect following the first census conducted after its enactment and the subsequent delimitation exercise to readjust constituency boundaries and seat allocations among states. A gazette notification confirming the 2023 act had come into force was issued shortly before the special session, yet its operational rollout remained contingent on the completion of those processes, which are not expected before the 2029 general elections.
Accompanying the women's reservation tweak were proposals under the Delimitation Bill, 2026, and related union territory laws that would have empowered Parliament to direct delimitation using 2011 census population figures rather than awaiting the next census, projected with a reference date of March 1, 2027. The changes envisioned expanding the Lok Sabha from its current 543 seats to approximately 850, with a corresponding increase in state assemblies, while allocating one-third of the enlarged house—around 272 seats—to women. Proponents argued this linkage would accelerate women's participation by avoiding further delays inherent in conducting and processing a fresh census. Home Affairs Minister Amit Shah stated in Parliament that delimitation was essential to ensure every voter holds equal value in a nation exceeding 1.4 billion people, emphasizing that post-expansion, representation would better reflect demographic realities.
Opposition parties, however, contended that the government was leveraging the widely supported goal of women's empowerment to advance a separate and divisive delimitation agenda through the backdoor. They noted that the 42nd Constitutional Amendment of 1976, extended by the 84th Amendment in 2001, had frozen seat allocations based on the 1971 census to incentivize population stabilization, with the freeze set to lift after the first census following 2026. Southern states, which have achieved lower population growth rates, expressed fears that shifting to 2011 data would penalize their political influence by reducing their relative share of seats in favor of more populous northern states, where the ruling party maintains stronger support. Lawmakers from the Dravida Munnetra Kazhagam (DMK), governing Tamil Nadu, attended proceedings dressed in black as a mark of protest, while Tamil Nadu Chief Minister M.K. Stalin publicly described the proposal as a punishment for southern states and staged a symbolic burning of the bill in Namakkal.
Congress leader Priyanka Gandhi Vadra challenged the government to convene an immediate session on the following Monday to reintroduce the unaltered 2023 women's reservation law for prompt implementation on the existing 543 Lok Sabha seats, declaring that all parties would support it and allow a clear determination of who stood against women's rights. She argued that the sudden special session, with the draft shared only a day prior, left insufficient time for scrutiny and appeared designed to advance delimitation under the cover of women's issues. Rahul Gandhi, another senior Congress figure, asserted that the proposal had nothing to do with women's empowerment and instead represented an effort to alter India's electoral map. Shashi Tharoor, also from Congress, warned that linking the reservation to delimitation effectively held women's aspirations hostage to one of the most contentious political exercises in the country's history, potentially leading to a tyranny of the demographic majority dominated by a few large northern states.
Prime Minister Narendra Modi appealed to lawmakers not to view the matter through a political lens, urging unity in the national interest to seize the opportunity for women's reservation. Following the vote, he accused the opposition of crushing the dreams of India's women through selfish politics and predicted that women across the country would deliver a fitting response at the ballot box. The government maintained that a uniform approximately 50 percent increase in seats across all states would preserve overall proportionality and prevent any undue shift in regional influence, though critics observed that the draft legislation did not explicitly codify such guarantees in a manner that fully addressed concerns.
The defeat highlighted deep federal tensions over delimitation, an exercise last comprehensively undertaken following the 2001 census with orders finalized in 2008. Projections based on 2011 population data, even under an expanded house, illustrated potential shifts, with states such as Uttar Pradesh, Bihar, and Rajasthan gaining seats while Tamil Nadu and Kerala would see reductions in their proportional share if total numbers remained fixed. The accompanying Delimitation Bill, 2026, which sought to establish a commission comprising a Supreme Court judge or former judge as chairperson along with election commissioners, ultimately became infructuous alongside the constitutional amendment. The government subsequently withdrew the standalone delimitation proposal.
Supporters of the 2023 act, including several ruling coalition members, welcomed its notification as a historic step toward equitable representation, noting that women currently constitute less than 15 percent of Lok Sabha members and often below 10 percent in many state assemblies. They pointed to experiences in local bodies, such as Bihar's panchayats where women's participation has exceeded 50 percent over multiple cycles, as evidence of the potential for broader leadership development. Parliamentary Affairs Minister Kiren Rijiju described the notification as part of an ongoing process and cautioned against politicizing the issue. BJP lawmakers emphasized the legislation's role in advancing the vision of a developed India by 2047, opening policymaking doors to nearly half the population.
Opposition voices, while reiterating their consistent backing for women's reservation—including support for the 2023 bill—insisted that implementation should proceed without entanglement in delimitation debates. They highlighted prior legislative efforts on women's issues under previous governments and questioned the timing and bundling of the proposals. Some media coverage of the vote drew criticism for framing the outcome primarily as a setback for women's reservation rather than a rejection of the delimitation-linked package, though the 2023 law itself remained unaffected and operative once delimitation occurs under its original terms.
The episode clearly reflects the challenges of balancing gender representation with federal equity in a diverse democracy. Delimitation inherently involves reallocating political power based on population, a process that has historically provoked regional anxieties despite constitutional mandates for proportionality. With the 2023 reservation now notified, its activation still hinges on the completion of census and boundary readjustment exercises, timelines for which extend beyond the next national elections. As Parliament adjourned without advancing the proposed changes, both the government and opposition signaled continued engagement on women's political participation, albeit with differing approaches to the sequencing and scope of related reforms. The broader implications for the composition of the Lok Sabha and state assemblies in 2029 and beyond will depend on how these intertwined issues of representation and redistribution are ultimately resolved through future legislative and constitutional steps.
