Trump Indicted for Illegal Attempt to Overturn 2020 Election Loss

A federal grand jury in Washington, D.C., issued charges against former U.S. President Donald Trump on Tuesday, accusing him of unlawful attempts to overturn the outcome of the 2020 election and maintain his hold on power. This legal action adds to his existing legal challenges as he seeks to win back the presidency in the 2024 election.

The extensive four-count indictment, presented by Justice Department special counsel Jack Smith, follows months of testimony from key Trump associates. They recounted how Trump's efforts to contest his defeat by Democrat Joe Biden ultimately failed, and Biden assumed the presidency in January 2021.

Contained in a 45-page document, the indictment alleges that the 77-year-old Trump engaged in a scheme to deceive the United States, infringe upon the rights of others, and obstruct the official process of Congress – specifically, the certification of electoral votes affirming Biden's victory. The charges include obstruction of the Electoral College's vote tally by Congress on January 6, 2021. This incident occurred amidst chaos when around 2,000 of Trump's supporters stormed the U.S. Capitol during a protest.

This marks the first instance in the nation's 247-year history where a former president faces accusations of unlawful attempts to secure an additional four-year term instead of peacefully transferring power to a successor. Trump is scheduled to make his initial court appearance on Thursday.

Despite numerous rejections of his claims by multiple judges following the 2020 election, Trump continues to falsely assert that he was denied reelection due to fraudulent voting and other election-related irregularities.

The indictment says, 

"Despite having lost, the Defendant was determined to remain in power. So for more than two months following election day on November 3, 2020, the Defendant spread lies that there had been outcome-determinative fraud in the election and that he had actually won.”
"These claims were false, and the Defendant knew that they were false. [He] repeated and widely disseminated them anyway – to make his knowingly false claims appear legitimate, create an intense national atmosphere of mistrust and anger, and erode public faith in the administration of the election."

The indictment further asserts that each of Trump's plots 

"targeted a bedrock function of the United States federal government: the nation's process of collecting, counting, and certifying the results of the presidential election."

As per the indictment, Trump allegedly collaborated through various means with six other individuals, although their identities are not disclosed in the indictment. Four legal advisors, a Justice Department official, and a political consultant were among them. The consultant reportedly aided in executing a scheme to submit false slates of presidential electors in favor of Trump, aiming to obstruct the certification process that affirmed Biden's victory.

This marks the second instance in the last two months that Trump has been indicted by Smith. In a previous 40-count indictment, Trump was accused of unlawfully retaining 32 highly classified national security documents at his Mar-a-Lago estate, contravening U.S. law by not transferring them to the National Archives upon leaving office. A trial for this case is scheduled for May 2024.

Furthermore, a prosecutor in New York has also indicted Trump on charges of altering financial records within his real estate conglomerate, the Trump Organization, in an attempt to conceal a $130,000 payment to an adult film star before the 2016 presidential campaign. The goal was to suppress her claim of a past encounter with Trump. This trial is set for March next year.

In Georgia, there are indications that a prosecutor may soon bring charges against Trump for his alleged efforts to unlawfully overturn the state's 2020 election results. Earlier in 2021, a recorded phone call captured Trump urging election officials to "find" him an additional 11,780 votes, one more than Biden's margin, in order to claim the state's electoral votes.

Trump has consistently denied any wrongdoing in these various cases, often criticizing Smith and prosecutors in New York and Georgia. He has reacted to the recent indictment, characterizing it as "nothing more than the latest corrupt chapter in the continued pathetic attempt by the Biden Crime Family and their weaponized Justice Department" to interfere in the 2024 election. He likened the indictment to practices observed in authoritarian regimes of the past - Nazi Germany in the 1930s, the former Soviet Union and others.

National polls indicate strong support for Trump among Republican voters as a potential candidate for the 2024 presidential nomination. A New York Times poll published shortly before the latest indictment showed Trump and Biden tied at 43% each in a hypothetical scenario where they face each other again in the election.
